We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

In no case shall Movin' Electric Vehicles, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Movin' Electric Vehicles and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Limited Warranty Terms

Last updated: June 12th, 2024

All Movin' Electric Vehicles Inc. electric vehicles, and their individual Covered Components (as defined in this article), are protected against all manufacturing defects in material or workmanship for one (1) year after receipt of the electric vehicles by the customer, except for the frame which is protected for two (2) years (the “Warranty Period”). This Limited Warranty is only in accordance with the following terms

- Only the original owner of an electric vehicle purchased from Movin Electric Vehicles Inc. website is covered by this Limited Warranty. The Warranty Period begins upon your receipt of the ebike and shall end immediately upon the earlier of the end of the Warranty Period any sale or transfer of the ebike to another person, and under no circumstances shall the Limited Warranty apply to any subsequent owner or other transferee of the ebike.

- The Limited Warranty is expressly limited to the replacement of a defective lithium ion battery (the “Battery”), frame, forks, stem, handlebar, headset, seat post, saddle, brakes, lights, bottom bracket, crank set, pedals, rims, wheel hub, freewheel, cassette, derailleur, shifter, motor, throttle, controller, wiring harness, LCD display, kickstand, reflectors and hardware (each a “Covered Component”).

- The Covered Components are warranted to be free of defects in materials and/or workmanship during the Warranty Period.

In the event Movin' Electric Vehicles Inc. determines a Covered Component is defective, Movin' Electric Vehicles Inc. will, as your sole and exclusive remedy and in Movin' Electric Vehicles Inc.’s sole discretion: (a) repair the defective Covered Component or free of charge with new or refurbished parts; or (b) replace the defective Covered Component with a new Covered Component.

This Limited Warranty Does Not Cover

- Normal wear and tear of any Covered Component

- Consumables or normal wear and tear parts (including without limitation tires, tubes, brake pads, cables and housing, grips, chain and spokes).

- Any damage or defects to Covered Components resulting from failure to follow instructions in the owner’s manual, acts of God, accident, misuse, neglect, abuse, commercial use, alterations, modification, improper assembly, installation of parts or accessories not originally intended or compatible with the electric vehicles as sold, operator error, water damage, extreme riding, stunt riding, or improper follow-up maintenance.

- For the avoidance of doubt, Movin' Electric Vehicles Inc. will not be liable and/or responsible for any damage, failure or loss caused by any unauthorized service or use of unauthorized parts.

- The Battery is not warranted from damage resulting from power surges, use of an improper charger, improper maintenance or other such misuse, normal wear or water damage.

DETERMINING WHETHER DAMAGE OR DEFECT TO AN E-BIKE OR COVERED COMPONENT IS PROTECTED BY THIS LIMITED WARRANTY SHALL BE IN THE SOLE DISCRETION OF MOVIN' ELECTRIC VEHICLES INC.

Shipping Damage

Damage to a Covered Component during shipping is not covered by this Limited Warranty, but Movin' Electric Vehicles Inc. will replace such damaged Covered Components if you:

- Notify Movin' Electric Vehicles Inc. of a Covered Component damaged in the shipping process within thirty (30) days of your receipt of the ebike;

- Provide Movin' Electric Vehicles Inc. with a dated picture of the damaged Covered Component

- Return all original packaging and paperwork included with the ebike at your sole cost, unless Movin' Electric Vehicles Inc. agrees writing to pay your shipping costs; and

- Note any immediately recognizable damage on the shipper’s Bill of Landing prior to signing off on the shipment.

Shipping damage claims are very time sensitive and it is your responsibility to immediately inspect the electric vehicle for damage upon receipt.

If you choose to set up your own independent shipping method, such as use of a freight forwarder or other similar service, Movin' Electric Vehicles Inc. will not replace any Covered Components damaged during such shipping method.

Claims Process

MOVIN' ELECTRIC VEHICLES INC. WILL NOT REPLACE ANY COVERED COMPONENT UNDER THIS LIMITED WARRANTY WITHOUT FIRST SEEING PHOTOS OR VIDEO OF THE DAMAGED COVERED COMPONENT.

In order to exercise your right to receive a replacement for a Covered Component under this Limited Warranty, you must:

- Visit this page on Movin' Electric Vehicles Inc. website: https://movinev.com/pages/contact-us and submit a contact form OR

- Initiate a conversation with us through phone, email or chatbot listed on Movin' Electric Vehicles Inc. Website. An employee will initially work with you on the problem with your electric vehicle to identify potential simple fixes.

- If the employee determines that a Covered Component must be replaced, they will provide you with a set of instructions for returning the defective Covered Component and receiving and installing the replacement.

- You will be responsible for shipping costs associated with returning a Covered Component, unless Movin' Electric Vehicles Inc. agrees in writing to pay for such shipping costs. Replacement Covered Components under this Limited Warranty shall only be shipped to the address of the original purchaser.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND MOVIN ELECTRIC VEHICLES INC.’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE E-BIKE, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. 

TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW MOVIN' ELECTRIC VEHICLES INC. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE FOR THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Refund and Cancellation Policy

In order to undertake a valid return, you must obtain written approval for such return from Movin' Electric Vehicles Inc., which can be obtained by completing the contact form. Please state the reason of your return and any products sent back to us by you without the written consent of Movin' Electric Vehicles Inc. shall be rejected and returned to you at your cost.

A cancellation of your order is subject to a cancellation fee equivalent to $300 U.S. Dollars.

To return a vehicle that is not defective or damaged, you must contact Movin' Electric Vehicles within fourteen (14) days of your receipt of the vehicle. The vehicle must be unused, free of any wear and tear, dirt, dust, fragrance, or any other signs of use and must be sealed and unopened in the same packaging and condition in which you received the ebike. You will be responsible for your own shipping to ship it back to us at the address: 95 Avenue B, New York, New York 10009

Refunds will be made after the ebike is received and inspected. The inspection process will typically take about one (1) week once the bike is received. Once the entire inspection is completed, refunds will typically be processed in about two (2) business days.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.
